Now imagine a number of candidates for a larger mission, is a position of trust and authority. The company plans to invest many hours training and education. Who would you choose?

So now the obvious legal issues:

First, the employers legal right (right) to know my conviction CFA?

1. Employers are permitted by state law to ask questions on any criminal convictions, including offenses, offenses and crimes that resulted in a conviction.

2. Employers have no right to know arrests that have been resolved in a dismissal or acquittal.

Right State of New York Executive (Human Rights Act) Section 296 (16)

Section 296 of the Executive Law of New York, it is illegal for an employer to refuse employment to someone based on their having already been declared guilty of a crime, or pursuant to a declaration of lack of "good character" because of his conviction a prior offense, then that this refusal constitutes a violation of Correction Law Article 23-NY A license (and the employment of persons previously convicted of one or more criminal offenses).

Under Article 23-A, employers of 10 or more employees are prohibited from hiring or decisions Classification according to the criminal record of a person unless:

(1) there exists a direct relationship between prior criminal offense (S) and the specific position of employment sought or in the possession of the person (see the example of a school bus driver)

(2) the hiring or continuing to employ a person who would involve an unreasonable risk to property or safety or well-being or the general public. Before determining that the criminal conviction of an individual person's employment or continued employment, Article 23-A requires employers to assess each of the following factors:

a. New York public policy encouraging the employment of former prisoners;
b. Roles and the specific responsibilities of the position applied for or held by the person;
C. The bearing, if any, crime (s) for which the person has already convicted will have on that person's fitness or ability to perform one or more functions or responsibilities of work;
d. The time that has elapsed since the occurrence of crime (s);
e. The age of the applicant or employee at the time of conviction;
f. The seriousness of the crime (felony offense cons);
g. Any additional information submitted by the person or on its behalf in connection with the rehabilitation and good conduct (Namely the Disability Allowance Certificate) and
h. the employer's legitimate interest in protecting their property and the safety and welfare of its employees and customers and the general public.

If the potential employer can know about my CFA can also ask me questions about my past and current drug / alcohol?

short answer is they can with some limitations. They can not ask questions that might indicate that there were drugs in the past one / problem with alcohol or an ongoing problem, because these investigations violate the Americans with Disabilities Act.

They can ask these questions:

1. Ever used illegal drugs?
2. When was the last time you took drugs?
3. Do you drink alcohol?

You can not ask how do or how you have used drugs.

But in practical terms, if we now know of his conviction for impaired driving, and you can drink or take drugs illegal what are their chances of employment with this company?

In the State of New York, you can never erase or seal involving a violation to DWAI (driving while impaired), and you can never erase the label, or erase a criminal record.
